Terms & Conditions — Brokk

These Terms & Conditions ("Terms") govern your use of the Brokk — Runes of Dawn physics puzzle game ("Brokk", "the app", "we", "us"), published by Fluttech. By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Licence to use the app

We grant you a personal, non-exclusive, non-transferable and revocable licence to use Brokk for your own private, non-commercial entertainment. You may not sell, rent, sublicense or commercially exploit the app or its content.

2. Accounts

The whole game is playable without signing in. Signing in with Google or Apple is optional; it identifies you in the app's Settings and puts your account on the leaderboards under the nickname you choose. You are responsible for activity that happens under your account and for keeping your sign-in credentials secure. You can delete your account at any time from Settings → Account → Delete account.

3. Purchases and rewards

This version contains no advertising and no in-app purchases. If a later version adds them, the following will apply, and the app's store listing and privacy policy will say so before it ships:

• In-app purchases would be sold by Apple or Google through their stores, under their terms, with prices shown before you confirm. Consumable items would be used up when spent and not refundable once used; non-consumable items could be restored on any device signed in to the same store account.
• Rewarded videos would be optional, and a reward granted only when the ad network reports that the video was completed.
• Virtual items would have no monetary value, could not be exchanged for money, and would be licensed to you for use within the app only.

4. Fair play and acceptable use

When using Brokk you agree not to:

• cheat, falsify or manipulate scores, stars, throws or streaks, or submit to a leaderboard a result you did not play;
• attempt to access, modify or interfere with other users' data, including their leaderboard rows;
• reverse-engineer, decompile, disrupt or overload the app or its services;
• use the app for any unlawful purpose.

We may remove a row or a name from a leaderboard, and restrict or terminate accounts that breach these rules.

5. Your content

The only thing you can publish in Brokk is the name on your leaderboard row, and a row goes up only after you join the boards or sign in. Every player using the app can see it. You must not use a name that is offensive, hateful, obscene, infringing, deceptive, impersonates somebody else, or is otherwise inappropriate, and you must not use it to advertise anything.

A nickname you choose is checked against an automatic profanity filter before it is accepted and is limited to 16 characters. The filter is not the whole of it: we may remove or replace any name we consider inappropriate, with or without notice, and repeated abuse can cost you the account. If you see a name that should not be on a board, report it to contact@fluttech.com and we will remove it. Brokk has no chat, no messaging, no profiles and no way to share images or audio, so a name and a score are the only things another player ever sees of you.

6. Intellectual property

The app — including its fortresses, the campaign through the nine worlds, the daily challenge, artwork, music, sound, design, name and logo — is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, distribute, modify or create derivative works from it except as permitted by applicable law.

7. Availability of the service

The app and its online parts (the fortress catalogue we publish, the sign-in it offers and the leaderboards) are provided on an "as is" and "as available" basis. A board may be reset, corrected or closed if it is broken or abused. We do not guarantee that they will be uninterrupted or error-free, and we may add, change or discontinue features at any time.

8. Disclaimer of warranties

To the maximum extent permitted by law, the app is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental or consequential damages, or for loss of data, arising from your use of (or inability to use) the app. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

10. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you breach these Terms.

11. Changes to these Terms

We may update these Terms from time to time. We will update the date above and, where appropriate, note significant changes in the app. Continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Romania, without regard to its conflict-of-laws rules, and are subject to any mandatory consumer-protection rights of your country of residence. Consumers in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
